The work seeks to discuss how was in Brazil the construction of the health system and evaluate the design of the right to health as the foundation released by the Federal Constitution of 1988. To do so, it is argued that the exclusion of health system took place not only in its own structure, by the way were designed public policies, but also in the microstructures, through the area exercised by medical knowledge, contributing so that citizens were once again subjected to the condition of State protection object. It is that the health care system continues to be a control mechanism and deletion, nevertheless have assumed a more subtle after the standardization of guidelines of equality and universality in health care by the Constitution of the Republic. As the Government cannot deal with this problem, it is exported for the judges, for those citizens who obtain clarification needed to go in search of their rights.
