The Responsibility of the Factors Involved in Checking the Awarded Documentation and Means of Attack within the Process of Public Procurement

Like allactivities coveredby the law, the procurement processrequiresthe existence ofappropriatecontrolsat all stages ofits development. Controlis performed bybodiesauthorized by lawandin whosesphere of activityliestheirresponsibility.In this paperwe will presentschematicallythe stages ofpublic procurementas well as thesequence of activitieswithin thesephasesprovided by the legislationin force governingpublic procurement, namely G.E.O no.34/2006, as amended by Government EmergencyOrdinance77/2012.We will alsoinvestigatethe remedies providedby the regulations inforce, which will beused bythose who havealegitimate interest inapublic contract.Also, we will analyse the functioning efficiency of some solutionoperationsofbodies responsiblefor remediesinthe procurement process, taking into account the time, but also howthesecomplaintshave beenresolvedin recent years
