Psystar's attempt to beat a copyright and trademark infringement suit brought by Apple Computers with an anti-trust counter-suit has been thrown out by a US judge.rnJudge William Alsup ruled that Apple was not engaged in anti-competitive practices by restricting the sale of its software on competitors' computers, such as those manufactured by Psystar.rnThe judgment is a setback for Psystar which was initially sued by Apple for copyright and trademark infringement in August 2008. Apple alleges that Psystar has been infringing on its IP by manufacturing clones of its computers which feature Apple's Mac OS X operating system.rnPsystar's suit challenged Apple's requirement that only Apple-branded devices use its software, which Psystar contends illegally ties the sale of one product to another. However, in his 16-page decision, Alsup ruled Apple's products do not constitute a market to dominate. As a consequence, Apple cannot be considered a monopolist.
