The recent case of BHP Billiton Petroleum -v- Dalmine examined the interesting question of the burden of proof in claim proceedings. BHP was a joint venture company engaged in the exploitation of oil and gas in the Liverpool Bay area of the Irish Sea. As part of the venture, a submarine gas re-injection pipeline was laid between two of the platforms in the field some 37km apart. Dalmine manufactured the steel pipes incorporated into that pipeline.
