Kier in dispute with luxury hotel firm

Kier Construction is embroiled in a legal dispute with luxury hotelier Dorchester Group over subcontractor discounts obtained when it carried out work at the 45 Park Lane project. Dorchester has claimed Kier obtained "undeclared discounts" from M&E subcontractor Mitie on the 2009 job, which, "contrary to the contract between Dorchester and Kier, they did not disclose or pass on to Dorchester". The details of the claim emerged in a High Court judgement handed down last week. According to the judgement, an adjudication prior to proceedings identified £686,000 in undisclosed discounts, an amount which the judge said had subsequently been paid to Dorchester.
