As a matter of english law, where a contractor has committed a repudiatory breach - has indicated an intention no longer to be bound by the terms of the contract - the employer has the right to elect either to terminate the contract or to affirm the contract and continue business as normal. Depending on the circumstances there may be a repudiatory breach in cases of abandonment of the work or a series of serious and continual breaches.
