Personal jurisdiction: Where cyberspace meets the real world - Part Ⅱ

This article continues in Part Ⅱ the analysis of jurisdictional issues raised by the Internet. Part Ⅰ focused on why personal jurisdiction is an issue in the electronic era, defining some basic concepts intended to help a better understanding of the elementary rules governing the exercise of jurisdiction. Section B which continues below, focuses on Internet jurisdiction, both as a microcosm of interstate litigation and as the birthplace of the Internet. Section C, considers the second largest block, the European Union. This part looks at the Brussels Convention and its Internet orientated revision, the Brussels Regulations. The final section concludes that the courts have adopted and adapted traditional jurisdictional rules to resolving disputes arising from online activity, makes a passing reference to the Hague Convention and suggests methods of minimising jurisdictional difficulties. This article has been published in CLSR in two parts (see [2005] 21 CLSR 464).
