E-commerce is not going anywhere anytime soon. If companies want to avoid class actions and the potential of litigating in foreign courts, they should require customers to affirmatively demonstrate their acceptance of the Web site's terms and conditions and they should take special care to ensure that the arbitration provision itself does not have terms and conditions that are too one-sided.
