Public law aspects of employment of magistrates in the Commonwealth Caribbean

Magistrates find themselves uniquely at the centre of the divide between the executive and the judiciary. They are not protected specifically under the constitution like judges of the High Court and Court of Appeal. The only protection that they are afforded under the constitution mirrors that provided for other public officers, namely, magistrates are to be appointed, disciplined and removed by the relevant service commission - usually the Judicial and Legal Service Commission. However, magistrates enter into contracts of employment with the executive: it is this peculiarity which has created much controversy and is at the heart of the employment issues that magistrates face in the Commonwealth Caribbean.
