The Pre-action Protocol for the resolution of clinicalndisputes, the first major work of the ClinicalnDisputes Forum (CDF), was implemented officiallynon 26 April 1999, annexed to the new CivilnProcedure Rules (CPR).1nThe new approach to civil disputes is now expectednto be less adversarial, with parties being required tonadopt a more cooperative approach, whether at thenpre-action stage or following the issue of proceedings.nThe overriding objective is to reach just outcomes asnexpeditiously as possible. The general aim of the PreactionnProtocol is therefore to maintain or restore thenpatient–healthcare provider relationship and to resolvenas many disputes as possible without litigation.
