EMISSIONS TRADING AND THE WASTE INDUSTRY

On 13 October 2003, the European Parliament and Council adopted a new Directive establishing a scheme for greenhouse gas emissions trading (the EU Emissions Trading Scheme or "EU ETS"). On 31 December 2003, the UK Government passed regulations (the Greenhouse Gas Emissions Trading Scheme Regulations 2003) implementing the EU ETS . The scheme is due to commence throughout the EU on 1 January 2005. Under the EU ETS, certain installations which emit greenhouse gases will be allocated a quantity of emissions, and will be obliged to buy emissions "allowances" if they emit more than that allocation (and permitted to sell emissions "allowances" if they reduce emissions to levels below their allocation).
