Serving Notice

Q I work as an enforcement officer for a local authority. I have a need to send a notice to a person that I believe can give me information on a serious fly-tipping. The information I require does not involve a vehicle so I cannot, I am told, use Section 71 (2) of the Environmental Protection Act 1990. I have been told to use Section 108 of the Environment Act 1995, but again this does not seem to fit as there is no entry on to a premises involved. The person will not come forward to be interviewed and will not answer any letters or speak to us. The police will not arrest him on suspicion of fly-tipping either. I need a notice that will either be answered and give me the information I need or, if not, provide me with a prosecution case against the person for not answering the notice. Have I misread Section 108?
