QMy borough has just written to me saying I must recycle. Also, I must put my bins and bags on the footpath after 8pm and before 6am for collection and take them back the following day, with the threat of being fined or the Council's bin being removed. Section 46 notices have not been issued. Now I see in the Daily Mail that another district is also threatening its residents. It says that a section 46 notice will be issued before any penalty. However, I suspect that these authorities, and others, have not read section 46 closely. Section 46(1), (2) and (3) say that a notice can require the occupier to place waste for collection in receptacles of a kind and number specified. If a notice has not been issued, can the authority limit the number, size or type of bins or bags used by the occupier?
