THE recent Court of Appeal decision in Triple Point Technology inc v PTT Public Co Ltd (2019) EWCA Civ 230 provides guidance on the application of damages when a contract is terminated or abandoned. Clients who were caught out by the Carillion collapse and the recent Dawnus collapse read on! But first a bit of background. The case in the first instance, Triple Point Technology, Inc v PTT Public Company Ltd (2017) EWHC 2178 (TCC) was handed down on 23 August 2017. Triple Point Technology is a company incorporated in the State of Delaware. Its business included the design, development and implementation of software for use in commodities trading. PTT Public Company Limited is a company incorporated in Thailand, which undertakes commodities trading.
