EPA has issued a court-ordered final rule for reducing air toxics emissions from industrial boilers. However, because the final rule differs significantly from the agency's proposed rule, EPA says it expects an additional public comment period is necessary. The Clean Air Act required EPA in 2000 to consider updating its Maximum Achievable Control Technology (MACT) standard for Industrial boilers. Environmental groups sued the agency, saying the subsequent rule was inadequate, eventually resulting in the Jan 1, 2011 deadline for a revised MACT. ACC says it remains concerned about changes recommended by the chemical industry but not included in the final rules.
