In 2008, the Office of Fair Trading decided not to refer Arriva's part-acquisition of KMP to the Competition Commission because it had received 'specific evidence' that another competitor intended to enter the Llandudno-Bangor market, and this was 'sufficient to address any potential substantial lessening of competition arising from the merger'. Given that no such operator has emerged and Arriva's fares on the Llandudno-Bangor corridor are significantly higher than on other Bangor routes, does the OFT believe in hindsight that it made the wrong judgment? OFT spokesman Frank Shepherd responds: 'The OFT does not generally consider whether, in hindsight, its individual merger decisions were 'right' or "wrong' since the decisions taken are taken on the basis of information known to the case team as a result of its investigation.
