The Building and Construction Industry Security of Payment Act 1999 (NSW) has three key aims: (a) to give a party a right to progress payments under a construction contract; (b) to abolish pay when paid clauses; and (c) to provide for rapid adjudication of payment claims and payment following that adjudication.
