HI-TECH TELECOM v RSL COM AUSTRALIA

RSL Com Australia provided telecommunication services to Hi-Tech Telecom under a contract for services. A dispute arose as to fees due under that contract and RSL brought proceedings against Hi-Tech. RSL claimed $2,125 million for services provided; Hi-Tech asserted that no moneys remained owing and that RSL's billing system was inaccurate. The parties subsequently entered into a settlement deed which provided for an expert to determine the amount (if any) due. The deed required each party to provide the expert with reasonable access to documentation and such other information as the expert might request for the purpose of making a determination.
