BLMCO 39 webinar explains Piracy Clause

In recent months BIMCO has received a number of enquiries from concerned shipowners uncertain of their contractual position in respect of the risk of piracy. The main concerns centre around whether an owner can refuse a charterers' orders under a time charter to proceed to or through an area where there is a significant risk of pirate attack; whether the vessel if seized and detained by pirates will remain on hire; and what are the consequences of any deviation even if agreeing to proceed. In addition, there is the question of the allocation of costs should the owners assume this extra risk.
