A number of new clauses, plus laytime definitions, were approved at the recent General Meeting in Paris and are now available to the industry. Laytime and demurrage are fundamental to tramp shipping. Specialist terms have evolved over the years and have been analysed by legal commentators and frequently tested in the courts. Subtle distinctions have emerged where a choice of term, use of language or insertion of untried phrases can advance or delay the commencement of laytime. This, in turn, can make the difference between demurrage starting on Friday afternoon or the following Monday, and possibly later in the event of an intervening public holiday.
