The township of Tinicum, Pa., may not impose a privilege fee on airlines flying out of Philadelphia Airport, according to a ruling by the U.S. Transportation Dept. on the matter. The township imposed the fee on airlines after it failed to reach a deal with the City of Philadelphia on past due property taxes, since parts of the airport abut Tinicum (DAILY, Sept. 26). The fee was challenged by IATA, the Air Transport Association and the Air Carrier Association of America, citing the Anti-Head Tax Act, which prohibits the imposition of taxes, fees and charges by state and local jurisdictions on airlines and other airport users.
