While the Bill, if passed, does not automatically validate the McGlade ILUAs, it paves the way for the parties involved in the dispute to resubmit the ILUAs for registration with the Registrar of the National Native Title Tribunal. Passing of the Bill into law will reinstate the status quo and provide certainty to all stakeholders relying upon defective ILUAs. These ILUAs can continue to be utilised by stakeholders and native title groups to provide benefits to all parties involved.
