What Do They Really Know About Me in the Cloud? A Comparative Law Perspective on Protecting Privacy and Security of Sensitive Consumer Data

In the United States and the EU, privacy laws need to be reformed to provide a solid regulatory foundation for the growth of cloud computing. A primary goal of reform should be to adopt laws that help ensure sensitive consumer data will be kept private and secure in the cloud. CSPs as well as companies hoping to gain the business advantages of using cloud computing to store and process customer data will benefit from having well-designed privacy laws that clarify the obligations of businesses to protect consumers' sensitive personal data and help build consumer trust in cloud computing. Reform should include expanding the legal definitions of sensitive data that deserve heightened data protection and reducing regulatory constraints that currently limit EU and U.S. businesses from taking full advantage of the benefits of cloud computing.
