In a January 24, 2008 final rule (73 FR4312-4377), EPA modified the monitoring regulations applicable to sources regulated by federally administered cap-and-trade programs. The changes to 40 CFR Parts 72 and 75 included in the final rule affect sources regulated under the acid rain program, the nitrogen oxides (NO_χ) budget trading program, the clean air interstate rule, and the clean air mercury rule. Note that, on February 8, 2008, the U.S. Court of Appeals for the District of Columbia Circuit vacated the clean air mercury rule (New Jersey v. EPA, No. 05-1097 [D.C. Cir. Feb. 8, 2008]).
