Buy American and the Berry Amendment

The Buy American Act and the Berry Amendment are hotly debated issues, centered around increased national security and national economic security. The 1941 Berry Amendment provisions require that certain products procured by the DOD be made with 100% U.S. content and labor. Recent amendments have required tightening of the waiver process, except in the case of some specialty metals; directed the DOD to purchase U.S.-manufactured metal items; increased the minimum domestic content from 50% to 65%; and required the secretary of defense to identify critical technologies and components vital to national defense and require that future items in these categories be 100% manufactured in the U.S.
