TIME TO HEAD OFFSHORE?

The Limited Liability Partnerships (Guernsey) Law 2013 came into force on 13 May 2014 in response to increasing demand for limited liability partnership (LLPs) structures in Guernsey and following the successful adoption of such structures in other jurisdictions. In the short period since then, the breadth of potential uses for LLPs has become evident. Fundamentally, a Guernsey LLP is not a partnership and Guernsey partnership law does not apply to it. A Guernsey LLP, like its UK and Jersey counterpart, is a body corporate with unlimited capacity and its own legal personality separate from that of its members. Unlike its UK and Jersey counterparts, it may be formed in Guernsey to carry on lawful business with a view to profit, or any other lawful activity.
