国内电子交易小额纠纷在线解决机制探究

摘要

With the rapid development of China's e-commerce, electronic transaction disputes are more and more kinds of complex. The traditional dispute settlement mechanism is not used to solve the problem of electronic trade disputes, especially in small disputes because of its long time, long reaction time, low efifciency and high cost. Online Dispute Resolution (ODR) is one of the essential legal assistant measures to develop e-commerce and network economy because of its fast, low cost, convenient and so on. At present, the development of ODR in China is at the exploration stage, there is no sound system and a complete solution, a large number of disputes can not be effectively resolved, which seriously restricts the development of e-commerce in China. This article mainly discusses the development of ODR in China, and puts forward his own views on the problems that ODR is facing.%随着我国电子商务的快速发展,电子交易纠纷也越来越多且种类繁杂.而传统的纠纷解决机制因其耗时久、反应时间长、效率低、耗资大等缺点已不适应用来解决电子交易纠纷尤其是小额纠纷问题.在线纠纷解决(ODR)因其快速、费用低廉、便利等价值因素,成为发展电子商务和网络经济必不可少的法律辅助措施之一.目前,国内ODR发展处于探索阶段,没有健全的制度和完备的解决机制,大量的纠纷无法得到有效解决,严重制约了我国电子商务的发展.文章主要探讨国内ODR的发展现状,结合ODR目前所面临的问题提出自己的看法.
