农村集体经营性建设用地入市障碍及对策

         

摘要

为保障农民的土地权益,推进城乡一体化建设。农村集体经营性建设用地应当与国有土地同价同权,实现农村土地交易无缝对接,建立城乡统一的建设用地交易市场。然而在实践中集体经营性建设用地的性质和流转缺乏法律制度保障;集体经营性建设用地分布不均;入市过程中地方政府和农村集体间存在利益冲突,存在侵吞农村集体组织土地利益问题。通过司法解释完善土地法律,赋予农村集体组织议价权;对可流转土地发放交易许可证,对属性界定含糊的土地性质重新划分等级定性;用行政许可方式对经营性建设用地所有权主体进行授权;引入企业化模式,创新入市流转收益分配法律制度。%To protect farmers' land rights and promote the construction of urban and rural integration,rural collec-tive construction land should operate with the same price and right of state-owned land, achieve seamless of rural land transactions, and establish a unified construction land market. However, the nature and circulation of collective constructive land are lack of legal guarantees in practice;collective management of construction land is unevenly distributed;there are conflicts of interests existing between the government and the rural col-lective in the process of entering the market, including problems of misappropriation of land interests of the ru-ral collective organizations. It is recommended to improve land law through judicial interpretation, and give the collective bargaining rights of rural organizations;grant trading licenses to the circulation of land, and define the vague nature of the land re-division level qualitative;use administrative license for operating authorization subject construction land ownership;introducing entrepreneurial model, innovation transfer income distribu-tion market legal system.
