The paper summarizes "Urban Underground Space Development Administration Measure" across 4 municipalities and49 "large cities" in China, and points out several dispute in the document level, the basic concept, the applicable area, the chapterstructure and specific content. Based on jurisprudential understanding of local laws and local underground space developmentregulatory system, the paper gives several recommendations on improving existing regulations, taking the normative document ashigh level, the city (or county) government as regulators, applying the regulations to the city planning area, laying a comprehensiveprocedural rules on local urban underground space development as the main content, stressing local concerns.%文章分析发现全国4个直辖市、49个"较大的市"的《城市地下空间开发利用管理办法》在文件层级、基本概念、适用地域和内容设置等方面存在制订争议.基于法理学认知,文章提出《城市地下空间开发利用管理办法》的制订建议:以高位阶的地方性法规或地方政府规章为文件发布层级,以"城市规划区"为适用地域,以综合性、程序性规则为主要设置内容,以凸显地下空间管控特色为核心和灵魂,以期能帮助提高各地制订《城市地下空间开发利用管理办法》的专业水准.
