马泰与马越共同开发案的比较研究

摘要

泰国湾与南海具有一定相似性。越南和马来西亚既是泰国湾的沿海国，也是南海争端国。马泰和马越共同开发都是泰国湾争议海域共同开发的成功案例。二者的争议性质、共同开发的背景和目的相似，但是谈判的过程、共同开发区的大小、“先存权”问题的处理、共同开发制度等相异。将二者进行比较研究，有利于把握争议海域共同开发的一些规律和特征，从中得出一些启示，为未来南海共同开发提供一些可行性的建议。%The gulf of Thailand bears some resemblance to the principal part of the South China Sea.Ma-laysia and Vietnam are both parties in the South China Sea disputes and the gulf of Thailand disputes.Ma-laysia-Thailand joint development and Malaysia-Vietnam joint development are successful cases of joint de-velopment in contested areas of the gulf of Thailand.This article reveals that the nature of disputes,the background and the aim of the two cases have similarities to some extent.But the course of the negotiation, the size of the joint development area,the disposal of the preexisting right and the joint development system are different.Through the study of two cases,the author finds some laws and characteristics of the joint de-velopment of disputed waters and hopes to provide some feasible suggestions for the future development of the South China Sea.
