国家公园建设中集体土地权属处置有三种典型模式：集体土地所有权和使用权收归国家所有、集体土地使用权流转、集体土地权属关系不变。权属处置过程中存在的突出问题：强征和“以租代征”，补偿不到位；强制流转，不合法征用，流转定价偏低、生态保护与农民自主经营权相矛盾等问题。建议：(1)加强部门联动，形成合力；(2)尊重农民意愿，严控征地范围，提高补偿标准；(3)完善流转市场，平衡生态保护与农民利益；(4)跟踪调研，开展试点探索，完善顶层设计。%Firstly, this paper introduces the three typical patterns concerning the disposition of collective land ownership. These include: collective land ownership and use right are nationally owned; rural collective land circulation; and collective land ownership remains the same. Secondly, this paper points out the problems that we face in the ownership disposition process. These are: land expropriation under coercion, land-renting instead of expropriating, and unreasonable compensation, forced transfer, illegal requisition, low transfer pricing, and the contradiction between ecological protection and farmers’ autonomy in management. On account of this, this paper proposes that departmental interaction must be strengthened with a view to form the joint effort. At the same time, we need to respect the wishes of farmers, rein the scope of land requisition and increase compensation standards. On this basis, we should improve the lfow of the market mechanism, balance ecological protection and farmers' interests, implement follow-up investigation and pilot exploration, and improve the top design.
