我国矿政管理法规政策调整状况

         

摘要

我国行政审批改革是为了简化行政管理,放活市场。2013年以来,国土资源部全面开展行政审批事项清理,截至目前,国土资源部共保留矿产资源行政审批事项11项,取消了32项矿政审批及非行政许可事项,占总审批及许可项目的70%多;对相关法规进行了初步调整,创新了矿政管理方法,实行矿业权审批公示公开,建立“黑名单”制度,强化信用约束,公开勘查开采信息等。但主要的法律、法规修改滞后,亟需修订《矿产资源法》及其配套法规,建立透明高效的国土资源执法监督管理体系,研究制定投资找矿勘探项目及地质找矿测量工作准入管理新机制。%Since 2013, the affairs pertaining to administrative examination and approval has been cleaned up in an all-round way by the Ministry of Land and Resources. As a result, a total of 11 mineral resources administrative examination and approval matters have been retained, while 32 mining administrative and non-licensing approval items have been cancelled, accounting for more than 70% of the total examination and approval and permission projects. The efforts they have made are also include: preliminary adjustments to relevant laws and regulations, developing new methods of mining administration management, opening the approval of mining rights, setting up a blacklist system, strengthening credit constraint, and making the prospecting and exploitation information known to the public. However, there are some problems that we face in the reform of administrative examination and approval. These are as follows: there is a lag in the modiifcation concerning the major laws and regulations, so the Law of Mineral Resources and other regulations need to be revised; open and high efifcient supervision and management system of law enforcement should be established; a new mechanism of permission management regarding investment in prospecting exploration projects and geological prospecting measurements must be researched on and developed.
