道地药材是我国具有战略地位的优势资源,运用地理标志制度保护道地药材在我国实际运用能力及运行成本上都最为经济,一定程度上起到了规范中药材市场和提高道地药材附加值的作用.但地理标志制度不能真正解决道地药材的名称权问题,不能保护道地药材的种质权和专有技术问题,不能有效保护道地药材所蕴含的多重市场价值,不能满足道地药材产区变迁的客观需要.%Genuine medicinal materials have become the national strategy advantage resource at the present times. The application of geographical indication legal system to protect genuine medicinal materials will be easy and e-conomic. It can manage the market well and upgrade the added value of genuine medicinal materials. However, geographical indication system cannot serve questions of name rights, idioplasm rights and special technologies. It is unable to reflect the multi-market value and requirement of raising place change.
