我国传统医药知识产权专利申请与授权分析

摘要

目的:探讨中医药知识产权专利在保护和开发过程中所存在的问题和矛盾.方法:通过对比国内外主要知识产权机构数据库中公布的中医药专利申请和授权信息,分析和总结了近年来基于中医传统知识创新和创造的特征与规律.结论:传统医药知识资源的政策设计,不仅要注重传统医药知识中"现有技术"的保护,更要注重对传统医药知识的开发利用,促进中医药专利向产品的转化.政府需要加强对科研机构和制药企业在政策与法规上的引导,发挥中医药资源的功用,造福人类.%Objective: To explore the problems and contradictions in the process of protection and development of intellectual property rights of Traditional Chinese Medicine ( TCM) .Methods:By comparing the patent application and authorization informa-tion of Traditional Chinese Medicine published in the database of major intellectual property institutions at home and abroad , the characteristics and laws of Traditional Chinese Medicine knowledge creation in recent years were analyzed and summarized .Conclu-sion: The policy design of the traditional medical knowledge resource should not only pay attention to the protection of "existing technology"in traditional medicine knowledge, but also pay more attention to the development and utilization of traditional medicine knowledge, that is to promote the transformation of Traditional Chinese Medicine patent to product .The Government needs to strengthen the guidance of the research institutions and pharmaceutical companies in the policy and regulatory , facilitate the great use of Chinese medicine resources and benefit the mankind.
