中国特色社会主义法学理论体系的现实基础

摘要

The practice of rule of law with Chinese socialist characteristics achieved greatly after reform and opening up. The legal system with Chinese socialist characteristics has been established, administration and government under law has been promoted, judicial system with Chinese socialist characteristics has been perfected, and legal education with Chinese socialist characteristics has been carried out. Such great practices need great theories to summarize. This theory system is composed with governance under law, state rule of law, theory on legal system with Chinese socialist characteristics and legal supervision theory with Chinese so- cialist characteristics. This system will be enriched, developed, and perfected by the practices on rule of law.%摘要：改革开放后，中国特色社会主义法治实践取得了令人瞩目的成就。具体表现在：形成了中国特色社会主义法律体系，依法行政和法治政府建设全面推进，建立和完善了中国特色社会主义司法制度，积极开展中国特色社会主义的普法活动和法学教育。伟大的实践孕育伟大的理论，中国特色社会主义法学理论体系就是对中国特色社会主义法治实践的总结和提升，这一理论体系主要包括依法执政理论、依法治国理论、中国特色社会主义法律体系理论以及中国特色社会主义法律监督理论等。中国特色社会主义法学理论体系将随着中国特色社会主义法治实践的不断推进而不断丰富、发展和完善。
