中国城市垃圾处置收费制度的健全与完善

摘要

With the urbanization stepping faster, city environment management is faced with the problem of appearance of ＂Garbage Siege＂ crisis. The fund delimma in garbage disposal makes the garbage disposal charge system emerge as a kind of economic incentive method. At the moment, the legislation about city garbage disposal charge system in our country has already taken shape, but there still exist many problems, such as legal provisions are too principled, charging standard is not unitary, charging mode is evidently hysteretic and legal liability investigation mechanism is not perfect and so on, which lead to current legal system cannot play a role in city garbage management.%随着城市化步伐的加快，“垃圾围城”危机的显现成为城市环境治理面临的难题。垃圾处理中的资金困境，更使垃圾处理收费制度作为一种经济激励手段应运而生。目前，我国有关城市生活垃圾处置收费制度的立法已初具雏形，但仍存在着法律规定过于原则化、收费标准不统一、收费模式明显滞后、法律责任追究机制不完善等诸多问题，导致现行的法律制度无法为城市生活垃圾的管理发挥作用。
