法律视角下的跨国公司环境责任强制保险制度--跨国公司近年来在华环境污染对我国环境责任保险制度的启示

摘要

With the rapid development of international exchanges and global economy , more and more transnational corporations establish factories and companies in China in order to expand the scale and some activities heightened the frequencies of environmental pollution accidents.From textile industry to IT industry, most of the TC products inevitably caused environmental pollution and destruction , whereas related enterprises are not insured for such environmental liability insurance , which exposed the lack of TC environmental liability insurance system. China has not established a perfect environmental liability insurance system, many environmental pollutions caused by transnational corporations in recent years have given a severe warning of China’s environmental liability insurance legal system.%随着国际交往的日益频繁和全球经济的快速发展，越来越多的跨国公司为扩大规模或扩张范围而在华设厂，随之而来的是对于我国环境的破坏。从纺织业到IT行业，大部分跨国公司产品在华生产的过程中都不可避免地造成环境污染和破坏，而相关企业并未投保针对这样环境损害的环境责任保险，充分暴露了我国对于跨国公司环境责任保险制度的缺陷。我国目前尚未建立完善的环境责任保险制度，近些年来众多跨国公司环境污染行为对我国环境责任保险法律制度的构建和完善，具有意义深远的警示作用。
