加强医学院校科研诚信建设的法律思考

摘要

Objective]In view of numerous behavior of violating medical research integrity that appearing around the world in recent years, seeking legal path to strengthen the construction of research integrity in medical university. [Method]Studying the problem existing in the construction of research integrity in medical university, proposing the corresponding countermeasures based on analyzing the status quo of administrative, civil and criminal legal regulation. [Result]At present, legal regulation of research integrity in Chinese medical field includes some issues such as lower legislative level, insufficient disclosure and transparency of information, smal punishment. We should seek effective ways to prevent and punish behavior of violating medical research integrity and form a good medical research atmosphere of independent innovation from the aspects of legislation and civil, administrative, criminal law. [Conclusion]It is significant to strengthen the construction of medical research integrity from legal perspective for containing research misconduct and protecting healthy development of research career in medical university.%[目的]针对近年来世界范围内出现的众多违背医学科研诚信的行为，寻求加强医学院校科研诚信建设的法律路径。[方法]研究医学院校科研诚信建设存在的问题，在分析行政、民事、刑事法律规制现状的基础上提出相应对策。[结果]目前我国对医学领域科研诚信问题的法律规制还存在立法层次较低、信息不够公开和透明、惩罚力度不强等问题，应当从立法以及民事、行政、刑事法律方面寻求防范和惩戒违背医学科研诚信行为以及形成自主创新的良好医学研究氛围的有效途径。[结论]从法律角度加强医学科研诚信建设，对遏制科研不端行为以及保障医学院校科研事业的健康发展具有重要意义。
