实现彝族民间纠纷解决机制与国家法律制度的良性互动——基于四川凉山彝族地区的实证分析

彝族人民在几千年的历史中,形成了以德古、家支头人等权威人士调解为主的民间纠纷解决机制。本文在分析彝族民间纠纷解决机制的运行情况及其存在问题的基础上,提出实现彝族民间纠纷解决机制与国家法律制度的良性互动。具体来说,要整合民间纠纷调解的资源,将彝族民间调解纳入现代法治体系,形成法院与彝族民间调解的良性互动。%In several thousand years of history,Yi nationality has developed their tradition in dispute resolution.Such dispute resolution mechanism mainly consists of mediation by authorized persons such as Degu and head of the family.This paper first analyzes the operation of the mechanism and the existing problems,and then puts forward that integrating the civilian dispute mediation resources into modern legal system be necessary to create a positive interaction between the mechanism and national legal system.
