马克思需要理论视域下对当代民主法治建设的思考

摘要

在马克思主义理论中，对于人性与法律都有较为系统的论述，显示出人的需要是促进法治健全的关键动因。依据马克思主义理论，对传统法制思想下人的需要特性的分析，对当代民主法治建设进程中，从艰辛曲折的开创性探索，过渡到突破性发展，延伸至当前科学有效地全面推进的探析，使我国法治建设更加科学性地满足人民的需要，摒弃意志本位、人治本位和义务本位，树立法律本位、法治思想和权利本位，将人之需要建立于法治权威常态下，全面推行依法治国。%In Marxist theory, there is the systematical discussion on humanity and law, which shows that people’ s needs is the key reason of improving the rule of law.According to Marxist theory, the paper analyzes the characteristics of the traditional legal thought of human needs on contemporary democracy and the rule by law in the process of construction, from hard pioneering explora-tion of twists and turns, transiting to breakthrough development, extending to promote the analysis of the current science effectively and building the rule by law more scientifically in China around the needs of the people.The paper suggests the will standard, rule by man and obligation standard should be abandoned, and the legal standard, the rule by law, law standard and right standard should be set up, to establish the authority of the rule by law to govern the country.
