Under the contemporary developing environment, land has huge economic value. But there exists ambiguous provision in the law concerning the income distribution in the land development and utilization among the country of its owner, the user ' s citizens and the resources of the land itself. Based on China's national conditions and advanced practice experience in foreign countries, reshaping distribution mode of the land development rights should be carried out from the regulation of authority in national land planning and land management, clarifying the share of land income of its land holders. So exploring and establishing appropriate income distribution mode of land development rights can relatively weaken the public and private interests of the two contradictions, and thus promote the realization of ecological civilization construction early.%土地在当代发展环境下具有巨大经济价值,作为所有者的国家、使用者的公民及资源本身的土地三方在土地开发利用过程中的收益分配却在法律上规定得模棱两可.基于我国国情,学习国外先进实践经验,重塑土地开发权的收益分配模式应从规制国家土地规划权力、土地管理权限及明确土地使用权人享有的土地收益份额等方面着手,探索并建立适当的土地开发权的收益分配模式,相对弱化公共、私人二者间的利益矛盾,促进生态文明建设的早日实现.
