论“三权分置”中土地承包权与经营权的权利性质

         

摘要

坚持土地集体所有,稳定土地承包权,放活土地经营权,是当前我国农村土地制度改革的又一次创新。“三权分置”改革将土地的社会保障功能以及财产属性有机契合。在学术理论界,将土地承包权界定为“成员权”和“物权”、将土地经营权界定为“债权”和“物权”的观点不一,正确界定土地承包权与土地经营权的权利属性是进行土地“三权分置”改革的必然要求。以价值取向和功能目标为标准将土地承包权和土地经营权均定性为用益物权,才会更好地完成土地制度的改革,实现土地效用的最大化。%Adhering to collective ownership of land, stabilizing the land contract right and liberalizing the flexibility of land management are the current reform of China's rural land system and a new innova-tion. "Three-division" reform combines social security function of land and the nature of property. In the academic community, opinions vary in that the contract right is defined as the member right and the real right; the land management right is defined as the creditor's rights and the real right. It is necessary to correctly define the nature of the right of land contracting and the right of land management. On the basis of the value orientation and function as the standard, land right and land management right are character-ized as usufructuary right so that the land system reform can be better completed and the land utility max-imized.
