政府信息公开例外规则的层次及其司法审查

摘要

According to the level of exemption, exemption rules in government information disclosure can be divided into three decreasing layers, namely, national security and public interest exemption, third-party interest exemption, and internal administrative information exemption. The judicial review for these three layers should use three standards successively, that is, a reasonable basis for the review, the basic starting point of the balancing of interests, and the combined attitude of respect and effective supervision. In this way, the information disclosure and independent administrative functions of administrative subject can be ensured.%政府信息公开例外规则依其例外的程度不同，可以分为国家安全与公共利益例外、第三方利益例外、内部行政信息例外三个逐次递减层次，对这三个层次的司法审查应当依次采用仅审查是否存在合理依据、以利益衡量为基本出发点以及尊重的态度和有效监督并举的三种标准，才能达到兼顾保证信息公开与保证行政主体独立行政职能的目的。
