中国古代食品安全监管的启示∗

     

摘要

The supervision system of food security in ancient China had multi-level functions including rule guiding ideology, specific legal regulation, supervision of folk guilds, etc, which together formed a system loss but never miss. The legal concept of going with nature and seasons, worshiping the heaven and following the earth was reflected from the supervision of food security in ancient China, the thought of“the ritual” was reflected in supervision regulation, the statute law and folk law were combined, and the folk association played an important role in it. The supervision of food security in China today can learn from the experience of the ancients, omni-directional supervision system should be formed, technical personnel of food industry should be introduced to the law enforcement teams, strict industry access system should be constructed, and the construction of social credit should be paid attention.%中国古代食品安全监管体系包括统治指导思想、具体法律规范、民间行会监管等多个层次,这些层次共同形成了一个疏而不漏的体系。中国古代食品安全监管体现了顺天应时、敬天法地的法制观念,在监管规范中体现了“礼”的思想,成文法与民间法相结合,民间组织在其中发挥着重要作用。我国目前的食品安全监管可以借鉴古人的做法,形成全方位监管体系,执法队伍应引进食品行业技术人才,建立严格的行业准入制度,注重社会诚信建设。
