关于社会责任壁垒与国际人权问题的思考

摘要

The barrier of social accountability used in the field of international trade is a new international trade barrier following the non-tariff barriers,such as the anti-dumping, countervailing, safeguard measures, and technical barriers.The social accountability is a kind of trade barrier which is not only the interests of politics and economy on both sides of international trade, but also involves two issues.One is whether the international trade and the civil rights can link under WTO law frame,the other is whether the international civil rights can be non-governmental.At present,we are faced with the fact lashed by the social accountability barrier in the field of international trade. The important reason is that the standard of our civil right is in line with the international standards. Even if it exceeds the international standards, there are many facts which don't match the international standards. Hence, it really demands us to think over and handle the issue positively.%社会责任壁垒运用于国际贸易领域,是继反倾销、反补贴、保障措施、技术性壁垒等非关税壁垒之后一种新的国际贸易壁垒.社会责任作为一种贸易壁垒,不仅体现了国际贸易双方政治经济利益的关系,而且涉及到国际贸易和人权在WTO法律框架下能否链接,以及国际人权能否民间化的问题.目前,我国外贸领域遭受社会责任壁垒冲击的事实,其重要原因是我国人权标准在法律层面是达标甚至是超标的,但在实际操作层面却存在着许多不达标的事实,这的确需要我们在宏观和微观方面做出积极思考和应对.
