日本修宪与宪法第九条问题研究

         

摘要

美国“钦定”的《日本国宪法》第九条规定:放弃战争和武力威胁、不拥有一切战争力量、不承认国家交战权。按照这一宪法规范,战后日本理应是一个放弃包括自卫战争权的非武装国家。然而,第九条并没有得到信守。美苏关系由协调走向对抗,进而美国全球冷战战略的实施,使美国的对日占领政策出现重大调整,战后日本外交和安保路线在右翼政府的主导下随之乘势转轨。其结果是:自我否定国家立场和国际承诺,以政府解释改变九条规范,使重新武装合法化,并在此基础上进一步谋求修宪,以彻底摆脱战后体制的束缚。%  Article 9 of the Japanese Constitution supervised by America stipulates that Japan should re‐nounce war and the threat of force ,not keep all war strength ,and not recognize the right of belligerency . According to the Constitution ,postwar Japan is supposed to be a country to abandon the war and the un‐armed self‐defense .However ,Article 9 is not abided by .US‐Soviet relation shifted from coordination to confrontation ,and then America's implementing global cold war strategy led to a major change of its occu‐pation policy in Japan ,whose post‐war diplomatic and security lines were also steered by the right‐wing conservative government .The result is that Japan's national stand and international commitments were ne‐gated ,and interpretation of Article 9 was changed by government so that they could legalize rearmament , then amend the constitution and finally break the bonds of the post‐war system .
