减刑制度完善的思考

摘要

Problems exist in the present commutation system,such as idea conflict between the current commutation system and punishment to fit the crime,lack of ruling institutions,non-detailed commutation standards,imperfect supervising bodies and supporting system and a need of amendment.Measures to be perfected at present are;the scope of commutation needs adjusting,special tribunals and hearing procedures needs establishing,the oversight functions of the procuratorate demands strengthening and the case trial procedures should be publicized.%现行减刑制度存在与罪刑相适应理念冲突、裁定机构缺失、减刑标准不够细化、监督机构和配套制度不完善等问题，需要对减刑制度进行完善。调整减刑的对象范围、建立专门的审理庭和听证程序、加强人民检察院的监督职能以及公开案件过程，是时下应当考虑的完善措施。
