现行《中华人民共和国环境保护法》（以下简称《环保法》）自2015年1月1日起施行，该法被称为“史上最严环保法”。新《环保法》是经济发展与法治发展的综合产物，新法突出以人为本，强调信息公开与公众参与，加大了社会监督的力度，强化了政府责任。同时，新法扩大违法规制范围，提高违法惩治力度，将政府责任、企业责任、公众责任有机整合，更具操作性与可适用性。本文将从环境问题与经济的协调性、环境保护优先及法律实施三个方面来浅析新环保法的实施现状。%“The Environmental Protection Law of the People’s Republic of China”(hereinafter referred to as “en-vironmental law”)came into force on January 1,2015,and it is known as “the most stringent environmental laws in history.”It’s the result of economic development and comprehensive development of law.The law highlights the people-oriented theme,emphasizes information disclosure and public participation,increases the intensity of com-munity supervision,and strengthens the government’s responsibility.At the same time,the law expands the scope of regulation,increases the intensity of illegal punishment,and improves the integration of government’s responsi-bility,corporate responsibility,public liability,and it is more operational and applicable.This paper will analyze the implementation of the new environmental law from three aspects:the environmental issues and the coordination of the economy,environmental protection priority and the implementation of the law.
