人案矛盾背景下公诉人出庭的挑战和对策——以简易程序为切入点

摘要

At present,in the judicial practice,the c ontradictions between criminal case and personnel have been intensified. The new Criminal Procedure Law has changed many aspects of summary procedure, accordingly,the prosecutor's work also will be affected. Based on the contradictions between the personnel and the criminal case,through comparing the new and old Criminal Procedure Law,this paper analyzes the reason why the prosecution work doesn't adapt to the new regulations,and puts forward suggestions and countermeasures.%目前,司法实践中的人案矛盾不断加剧,新《刑诉法》又修改了简易程序的诸多方面,公诉人的工作也随之受到影响.立足人案矛盾,通过比较新、旧《刑诉法》,阐述公诉工作面对新规定暴露出的诸多的不适应与不习惯,分析原因,进而提出建议和对策.
