我国体育竞赛表演著作权保护的法律性质探析

摘要

Whether sports competition performance is a work directly related to the athletes who may be have the rights of performers.There is a long time in this dispute.This paper analysis the nature of works and compare the ideas between two contrary sides;then give some legislation suggestions.Besides,it concludes that at present legislation may according to the Rome convention for some athletes give similar to the protection of the performers.%体育竞赛表演是否构成作品直接关系到运动员是否享有表演者的权利，这个问题争论已久。本文结合作品属性的认定及正反两方在这个问题上的观点，给出了相关立法建议，认为目前立法上可以根据《罗马公约》对一些运动员给予类似表演者的保护。
